NASET's Resolving Disputes with Parents Series--ARCHIVED

In drafting the provisions of IDEA, our nation's special education law, Congress clearly contemplated that, at times, there would be disagreements between parents of children with disabilities and the school districts providing special education and related services to their children. While it is expected that parents and school personnel will work in partnership to ensure children with disabilities are provided appropriate services, there are times when the child's parents and school officials cannot reach consensus on what constitutes a free appropriate public education (FAPE) for an individual child. When such disagreements occur, parents and school districts can turn to IDEA's procedural safeguards and dispute resolution options. Resolving Disputes with Parents Series is now complete, but you'll find up to date, authoritative information about critical aspects of resolving conflicts under IDEA within this series. You'll be pleased to hear that those procedures have been revised in the 2004 Amendments to IDEA and that disciplinary processes have been streamlined. The 9 part series of Discipline of Students in Special Education is presented each month (see below) so that you can find IDEA's requirements in specific disciplinary areas. The case study at the end looks at how IDEA's discipline procedures apply in a real-life situation. To read more about NASET's Discipline of Students in Special Education Series, click here
